WaPo reports the POTUS is expected to make a televised address tonight in which he will argue that foreign intelligence threats have undermined the security of our elections -- and specifically the one he lost in 2020 -- and that this means the federal government should take over elections which are managed by each individual state. The president has tried to hold up every major recent action by Congress in order to cajole them into approving a new law that would require proof of citizenship and and ID to vote in this year's mid-term elections.
Sen. Mark Warner (D-Va) just issued a statement outlining the facts about the 2020 election and the current election infrastructure. I'm pasting part of it here because it's a good resource for anyone following along and for reporters who have to write about this unfortunate chapter in our nation's history. It's also a preemptive rebut to and probably a preview of what we'll hear from the president this evening.
"Foreign adversaries routinely seek to influence U.S. elections. They spread disinformation, amplify political divisions, intimidate voters, incite violence, and attempt to undermine Americans’ confidence in democratic institutions.
What foreign adversaries have not done, according to repeated public, unclassified assessments from the U.S. Intelligence Community, the Cybersecurity and Infrastructure Security Agency (CISA), the FBI, the Senate Intelligence Committee, and bipartisan state election officials, is alter vote totals, hack voting machines to change election outcomes, or compromise the integrity of the 2020 presidential election. The clearest pattern across recent elections is not successful vote manipulation – it is sustained influence operations, aided and abetted by domestic actors, designed to convince Americans that their elections cannot be trusted.
These facts matter because conspiracy theories about stolen elections cannot become a pretext for weakening our democratic system or stripping states and local election officials of their longstanding constitutional role in administering elections. The answer to foreign threats is to strengthen election security, support state and local officials, and combat foreign influence operations – not to “take over” or federalize election administration based on claims that have been repeatedly investigated and debunked.
Reporters have a unique responsibility at this moment. The press is the only profession expressly protected by the Constitution because the Founders understood that an informed public depends on a free and independent press willing to separate fact from fiction and hold those in power accountable. Regardless of the source seeking to amplify false narratives about American elections, journalists should approach extraordinary claims with the same rigor they would apply to any other allegation: demand credible evidence, consult the extensive public record, engage subject-matter experts with experience tracking foreign intelligence operations, and provide audiences with the full context of repeated findings from the Intelligence Community, federal cybersecurity officials, bipartisan state election administrators, audits, recounts, and the courts. Careful, evidence-based reporting is one of the strongest defenses against efforts to undermine confidence in American democracy. To that end, we have assembled the following reference guide to help reporters quickly evaluate some of the most common claims about election security against the extensive public record developed by the Intelligence Community, CISA, the FBI, bipartisan state election officials, audits, recounts, and the courts.
Claim: China interfered in the 2020 election to help Biden.
Facts: Under the leadership of then-Director of National Intelligence John Ratcliffe, the Intelligence Community assessed that China considered but did not deploy influence efforts intended to change the outcome of the 2020 presidential election. By contrast, the IC assessed that Russia conducted influence operations aimed at denigrating Biden and supporting Trump, and that Iran conducted efforts to undercut Trump and sow division. The Intelligence Community, Department of Justice, and Department of Homeland Security all agree that there was no changing of votes or compromise of the integrity of election infrastructure in the 2020 election. Even the Minority View included in the public 2020 Intelligence Community Assessment – which assessed that China may have undertaken some modest influence operations – concurred with the overall IC assessment that there was “no information suggesting China tried to interfere with election processes.”
Claim: Venezuela, Dominion, or Smartmatic hacked voting machines.
Facts: In November 2020, President Trump’s own CISA, working alongside state and local election officials from both parties, declared the 2020 election “the most secure in American history.” CISA stated there was “no evidence that any voting system deleted or lost votes, changed votes, or was in any way compromised,” and highlighted the extensive safeguards built into U.S. elections, including paper records, audits, recounts, certification, and pre-election testing.
Claim: Georgia proves the machines were wrong.
Facts: Georgia’s post-election audit showed the opposite. Because the presidential margin was so close, the state conducted a full manual tally of all presidential paper ballots. The Georgia Secretary of State, a Republican, reported that the audit confirmed the original machine count accurately identified the winner, with differences within the expected range of human hand-counting error.
Claim: Foreign interference means votes were changed, or elections are illegitimate.
Facts: This claim conflates two different concepts. The IC has repeatedly warned that foreign adversaries conduct influence operations, including hack-and-leak operations, disinformation campaigns, and efforts to undermine confidence in U.S. democracy. But those assessments distinguish influence from interference such as alteration or manipulation of ballots, vote tabulation, or voter registration.
Claim: Foreign actors can easily flip a federal election.
Facts: Both the Senate Intelligence Committee and the Office of the Director of National Intelligence (ODNI) have said the decentralized nature of U.S. election infrastructure makes large-scale manipulation very difficult to carry out without detection through intelligence collection, audits, cybersecurity monitoring, and physical security controls. This assessment was reaffirmed by DOJ and DHS in a joint report on the 2020 U.S. Federal Elections – a report mandated by Executive Order 13848, which was signed by President Trump himself in 2018. Indeed, federal funding – much of which took place through appropriations bills under President Trump’s first term – helped shore up the security of state and local election systems in advance of the 2020 U.S. Federal Elections.
Claim: States cannot be trusted to administer elections.
Facts: The Founding Fathers thought otherwise, assigning the responsibility for election administration to states in the Constitution. As a result, elections are administered by more than 8,000 state and local jurisdictions, making centralized or outcoming-shaping fraud extraordinarily difficult. Election security relies on multiple independent safeguards – including but not limited to paper ballots or voter-verifiable paper records, bipartisan poll workers, post-election canvasses, audits, recounts where appropriate, and certification by state and local officials. The federal government’s role has historically been to provide intelligence, cybersecurity assistance, and voluntary best practices through agencies like CISA, the FBI, and ODNI (notably, resources the current administration has curtailed) – not to run or “take over” elections. A bipartisan Senate Intelligence Committee investigation recommended more support for state and local election officials, not replacing them with a federally controlled election system.
Claim: Dead people or non-citizens voted in large numbers, or there are more ballots than registered voters.
FACTS: These discrepancies are usually attributable to clerical or data issues, and while there are occasional isolated cases, multiple comprehensive studies have found that noncitizen voting is vanishingly rare. Notably, under President Trump’s influence, many GOP-led states have withdrawn from the Electronic Registration Information Center (ERIC) – the nationwide clearinghouse to assist states in improving the accuracy of voter rolls.
Claim: Mail-in ballots or ballot drop boxes are inherently insecure.
FACTS: CISA notes that states employ multiple, overlapping safeguards for mail-in and drop-box voting, including voter signature verification or other voter validation methods, ballot tracking, secure ballot handling and chain-of-custody procedures, ballot reconciliation, and post-election audits. The specific safeguards vary by state, but they are designed so that no single control is solely responsible for protecting election integrity. Importantly, mail-in voting has traditionally been a critical method of ensuring that military personnel can exercise their right to vote and has been commonplace in many states for over a decade.
The factual record is clear: Foreign adversaries try to influence Americans and undermine confidence in our elections, but unclassified government assessments and state audits have not shown that China, Venezuela, or any foreign actor hacked voting machines or changed vote totals in 2020. The real threat is not that Americans’ votes were secretly flipped; it is that foreign adversaries and domestic actors continue to spread false claims designed to make Americans doubt legitimate election results."

AUGUSTA — "Maine is denying the U.S. Department of Justice access to its voter registration records, state officials said Tuesday, rejecting an unprecedented request for sensitive voter data that the Trump administration has now delivered to all 50 states.
"A letter late last week to Secretary of State Shenna Bellows and signed by Deputy Assistant U.S. Attorney General Michael Gates claims Maine had roughly 11,000 voters with duplicate registration. It requested the state’s entire voter registration list dating back to November 2022 'to ensure that ineligible voters are being removed.'
"The state has 14 days to respond to the letter dated July 24.
"Bellows, who is also a Democratic candidate for governor, said in a press conference Tuesday the Trump administration is overstepping its bounds, empowering false narratives and 'trying to change the topic away from the Epstein files.'
" 'Article 1 of the Constitution places the states — not President Trump, not the federal government — in charge of federal elections,' she said. 'The DOJ doesn’t get to know everything about you just because they want to.'
"Bellows’ office is coordinating with Maine’s Office of Attorney General to draft a formal response, she said.
The Maine Republican Party has previously claimed widespread voter fraud across the state, but a subsequent investigation by Bellows’ office concluded this month and found those claims were baseless. Just because someone is registered to vote in two different towns doesn’t mean they intended to vote twice. Often, it simply means that they moved between elections.
"A spokesman for Maine Senate Republicans declined to comment on the DOJ’s request or Bellows’ response. Other Maine GOP officials did not immediately respond to requests for comment Tuesday.
"In addition to #VoterRegistration information, the DOJ also has requested the names of local election officials as well as information about noncitizens, felons, and deceased people’s alleged participation in Maine elections following President Donald Trump’s repeated false claims that the 2020 election was rigged and stolen from him.
" 'Please provide a description of the steps that Maine has taken, and when those steps were taken, to identify registered voters who are ineligible to vote as well as the procedures it used to remove those ineligible voters from the registration list,' the DOJ’s letter reads.
"The DOJ has not publicly said why they are seeking voter records across the country. Asked about the request to Maine and other states, spokesperson Pierson Furnish replied in an email 'No comment.'
"The first Trump administration similarly made requests to view all Americans’ voter information in 2017. Then-Secretary of State Matt Dunlap said at the time he would release voters’ names, ages, residences and districts with the government, as allowed by Maine law.
"The American Civil Liberties Union [#ACLU] of Maine said the DOJ’s actions both now and then are part of 'a clear pattern of intimidation' and applauded Bellows’ refusal to share voters’ information.
" 'This letter also fuels #FalseNarratives that sow distrust in our elections. Maine elections are safe, secure, and accessible, and that’s why Maine consistently has some of the highest voter turnout,' said Samuel Crankshaw, the group’s communications director. 'Our government should focus on helping more people exercise their fundamental rights.'
Maine’s voter turnout is reliably high compared to other states and more Mainers voted in 2024 than in any election before, according to state voting data.

The German government now intends to put into law to punish Germans with up to 5 years in jail if they deny Israel's "right to exist".
Such a law would of course very likely violate the German constitution, like virtually everything the current German government does these days. And Germany already has a law that protects anyone from incitement and hate against the group they belong to, including jews. A law that specifically protects Israel no matter what Israel does serves of course only to suppress valid criticism of genocide and Israel's hard-right course who currently want to attack Iran *again*. In a country that respects its own constitution, this planned law would never even have been proposed.

As I write this, Germany's foreign minister, Johann Wadephul, is on visit in Israel, Germany's "good and close friend", to "keep communications channels open" as public hostility towards Israel increases.
And Germany's minister of the interior, Alexander Dobrindt, and the federal presidents of Germany's police have had multiple visits in Israel, Germany's "natural partner", to start training each other's police and to learn from Israel how it controls a population in an apartheid state using technology and AI (the real, working all-too-well AI, like computer vision, not the LLMs that are sold to us as "AI").

"#Kayakers who say they oppose the direction the U.S. Supreme Court has taken the country took to the water Saturday morning to protest near the seasonal home of Chief Justice John Roberts Jr.
"The flotilla launched its kayaks from the new public landing in Port Clyde and paddled a few hundred yards to Roberts’ home on Hupper Island.
"The chief justice and his wife Jane Roberts purchased the home in June 2006. He typically spends time at the seasonal home after the high court recesses for the summer. Their chief residence is in Chevy Chase, Maryland.
Signs voicing opposition to the #SupremeCourt’s rulings were brought in the kayaks, and others lined the waterfront.
"Signs referred to rulings that they said harm the #LBTQ community, the overturning of campaign spending limits for #corporations in the #CitizensUnited case in 2010, the overturning of a woman’s right to #abortion in 2022, and more recent rulings that grant the president immunity from actions taken while president.
"Organizer Susan MacNeil-Densmore said earlier this week she is affiliated with the organization #AudacityCAT (#CreativeActionTogether) which has been active locally working to resist #authoritarianism, but said the event was not really part of any specific organization."

"The U.S. Department of Education – an agency the president is trying to abolish – announced Friday it has initiated an investigation into Maine’s Department of Education over allegations that school districts in the state are violating the Family Educational Rights Privacy Act (#FERPA).
"Specifically, the federal agency says school districts are allowing officials to create 'gender plans' that support a transgender student’s identity but then not making those plans available to parents.
"A similar investigation was launched in #California this week.

"Schools in Maine have been caught in a legal gray area between respecting student privacy and parents’ rights to be informed when it comes to children’s expression of gender identity while at school. Many youth live in families whose members might not be supportive of their gender identity.

How new protest laws are impacting political demonstrations
More than a dozen states have passed laws regulating protests in recent years, raising concerns among free-speech advocates.

In Congress, the Republican representative has introduced a similar bill — what he calls the '#ThumpThumpAct' — for drivers who may encounter protesters in other parts of the country.
" 'When the consequences for inappropriate behavior are severe enough, people will stop doing it,' Fine said. 'Blocking roads is a form of political terrorism. They should get run over.'
"Florida is one of more than a dozen states that have cracked down on protests in recent years, passing laws that often equate political demonstrations with riots in ways that #FirstAmendment experts say could be illegal.
"Since 2017, 23 states have passed at least 55 laws to address how and when people can protest, according to the International Center for Not-for-Profit Law, which tracks such statutes. The laws do such things as mandate at least 30 days in jail for rioting — often loosely defined as a group involved in tumultuous or potentially violent behavior — restrict protests on college campuses, and imprison and fine people who block sidewalks, streets and highways.
"Some lawmakers like Fine want federal legislation that mirrors those efforts. Among the 16 pending federal bills are proposals to tighten restrictions on protesting near federal judges, jurors or court staff; strip #nonprofits of their tax status for certain #protest-related activities; and block people convicted of rioting from small business aid.
"First Amendment advocates warn that the patchwork of state laws, pending federal bills and court battles risk rewriting the rules of public demonstrations. There are already laws to prosecute violent behavior, making these new efforts unnecessary, they say.
There have been few arrests or prosecutions under the recently passed protest laws, but free-speech advocates say the measures can be used to control or dissuade would-be demonstrators.
" 'What we have consistently seen is lawmakers responding to protest movements by introducing new laws that restrict the #RightToProtest,' said Elly Page, senior legal adviser for U.S. programs at the International Center for Not-for-Profit Law."

"In 2016 as a member of Congress, #DebHaaland stood for four days in solidarity with protesters at the #StandingRockSioux Reservation against construction of the #DakotaAccessPipeline. Today, as the first #NativeAmerican to be the secretary of the interior — the first to lead any cabinet department — she has the opportunity to support the #FirstAmendment rights of the protesters she joined in the past.
"With her authority over energy development on federal lands, Haaland can be a voice for Indigenous and climate movements facing an urgent threat: the rapid spread of laws to protect 'critical infrastructure' that single out activists.
"Since 2016, 13 states have quietly enacted laws that increase criminal penalties for trespassing, damage, and interference with infrastructure sites such as oil refineries and pipelines. At least five more states have already introduced similar legislation this year. These laws draw from national security legislation enacted after 9/11 to protect physical infrastructure considered so 'vital' that the 'incapacity or destruction of such systems and assets would have a debilitating impact on security, national economic security, national public health or safety.'
"Many industry sectors are designated critical infrastructure, including food and agriculture, energy, water and wastewater, and communications, but most state critical infrastructure laws focus more narrowly on oil and gas #pipelines. While protecting critical infrastructure is a legitimate government function, these laws clearly target environmental and Indigenous activists by significantly raising the penalties for participating in or even tangentially supporting pipeline trespassing and property damage, crimes that are already illegal. Many laws are modelled on draft legislation prepared by the American Legislative Exchange Council, also known as #ALEC, a powerful lobbying group funded by #FossilFuel companies like #ExxonMobil and #Shell.
"Central to the new critical infrastructure laws are increased criminal penalties and vague, broad definitions that could discourage protest and particularly, nonviolent civil disobedience. Many laws make any 'damage' to or 'interference' with a facility deemed critical infrastructure a felony. Under #Ohio’s law, trespass with the purpose of 'tampering' with a facility is a third degree felony punishable by up to 10 years in prison and a $20,000 fine. In Indiana, a felony conviction is applied for any facility trespass, a crime that is typically a misdemeanor or fine.
"Vague language like 'damage,' 'tamper,' and 'impede' in critical infrastructure laws makes it unclear if, for example, knocking down #SafetyCones and starting a fire next to a natural gas facility are the same under the law. Many critical infrastructure laws do not clarify if they apply only to land a company fully owns or also to pipeline easements, which run through both public and private lands. At least some laws apply to both. Only a week after Louisiana’s critical infrastructure law was enacted, opponents of the Bayou Bridge pipeline were charged with trespassing for boating on public waters on the border of a pipeline easement.
"The combination of overly broad language and steep penalties in critical infrastructure laws make it likely that future activists and supporting organizations will be discouraged from exercising their First Amendment-protected protest rights. A lawsuit brought in response to the #BayouBridge charges will test the laws for the first time on First Amendment grounds.
"Many of these laws even extend beyond the protesters. In a proposed law in #Minnesota, anyone who 'recruits, trains, aids, advises, hires, counsels, or conspires' someone to trespass without a 'reasonable effort' to prevent the trespassing is guilty of a gross misdemeanor. In #Oklahoma organizations that conspire with perpetrators are liable to be fined up to $1 million. These laws may infringe on the freedom of association protected under the First Amendment. Indeed, the Supreme Court ruled that the illegal actions of a few individuals do not implicate an entire group.
"The criminalization of environmental protest is fueled by federal security agencies and oil and gas companies, who are often major political donors. For years, the Department of #HomelandSecurity and the Federal Bureau of Investigation have labelled activists at infrastructure sites as #DomesticTerrorists and violent extremists in order to justify further #surveillance and #policing. Government documents have been released that detail the FBI’s focus on '#AnimalRights / #EnvironmentalExtremism,' describing even #NonviolentProtesters as #extremists.
"At Standing Rock, a private security firm [#Blackwater] hired by the pipeline companies consistently referred to protesters as 'terrorists' while working with law enforcement. Ahead of the #KeystoneXLPipeline protests in 2018, #DHS agents held an '#AntiTerrorism training' for state and local authorities. In contrast, members of the #FarRight militant group the #ThreePercenters have established a significant presence at oil and gas plants with little law enforcement reaction.
"To be sure, as the recent power outages in Texas showed so vividly, the United States needs reliable energy. But it’s questionable whether pipeline construction sites that could feasibly be moved or replaced with renewable energy sources should legitimately be considered 'vital' to the energy grid. Furthermore, a singular focus on this aspect of security comes at the cost of others. Whose essential resources do pipeline projects protect and whose do they threaten? Black Americans are disproportionately likely to live near natural #GasPipelines and experience higher #CancerRisk due to unclean air. An oil spill from the Dakota Access Pipeline could devastate the #SiouxTribe’s water source. Meanwhile, on some reservations, 10 percent of households lack electricity and as many as 40 percent of households must haul water and use outhouses. The well-being of these communities must count too.
"The rise in critical infrastructure laws may foreshadow more anti-protest legislation to come. A similar wave of anti-protest laws has already begun in response to the 2020 #BlackLivesMatter protests. State legislators contemplating critical infrastructure laws should bear in mind that laws that criminalize trespassing and protect the safety of construction workers and law enforcement already exist. Critical infrastructure laws don’t fill an unmet need — they only raise the penalties for specific groups of people. Courts adjudicating #FirstAmendment challenges in the coming years should recognize that these laws are overbroad and impose disproportionately severe penalties that chill freedom of assembly and association.
"As secretary of the interior, Haaland promises to uplift the voices of Indigenous and climate protesters in the Biden administration. State legislators, law enforcement, and the fossil fuel industry should follow suit and listen to these activists rather than suppressing constitutionally protected activity under the guise of national security."

:Mast’s new bill claims to target a narrow set of people. One section grants the secretary of state the power to revoke or refuse to issue passports for people who have been convicted—or merely charged—of material support for terrorism...
"The other section sidesteps the legal process entirely. Rather, the secretary of state would be able to deny passports to people whom they determine 'has knowingly aided, assisted, abetted, or otherwise provided material support to an organization the Secretary has designated as a foreign terrorist organization.'
"Rubio has previously boasted of stripping the visas and green cards from several immigrants based purely on their peaceful expression of #ProPalestine views, describing them as '#Hamas supporters.'

"The Department of Justice has removed a study showing that white supremacist and far-right violence “continues to outpace all other types of terrorism and domestic violent extremism” in the United States.
The study, which was conducted by the National Institute of Justice and hosted on a DOJ website was available there at least until September 12, 2025, according to an archive of the page saved by the Wayback Machine. Jason Paladino first reported that the study was removed. 404 Media noticed the removal after it was flagged by Daniel Malmer, a PhD student studying online extremism at UNC-Chapel Hill.
" 'The Department of Justice's Office of Justice Programs is currently reviewing its websites and materials in accordance with recent Executive Orders and related guidance,' reads a message on the page where the study was formerly hosted.
